Rio Tinto Sulphur Dioxide

Gratl & Company acts for Unifor Local 2301 to review the decision of the Minister of the Environment to allow the Rio Tinto aluminium smelter in Kitimat to forego mitigation of human health risks from sulphur dioxide emissions.

The Environmental Appeal Board initially refused to take jurisdiction over Unifor's challenge.  The Supreme Court of British Columbia overturned the EAB refusal to take jurisdiction.  Reasons for judgment are at http://tinyurl.com/nk9qbvy.  Rio Tinto appealed the decision and their appeal was dismissed.  Reasons for judgment dismissing Rio Tinto's appear are at http://canlii.ca/t/h5hxm

The matter is now before the Environmental Appeal Board.  It is anticipated that a hearing and pre-hearing applications will soon be scheduled.
